1. Hand forklifts import policy

When you import any type of item, you must first understand the import policy of that item. The policy on import of hand forklifts of all kinds is specified in the following legal documents:

  • Circular 38/2015/TT-BTC dated 25/3/2015; amended and supplemented 39/2018/TT-BTC dated 20/04/2018;
  • Circular 39/2016/TT-BGTVT dated 6/12/2016;
  • Decree No. 43/2017/ND-CP dated 14/4/2017;
  • Circular 12/2022/TT-BGTVT dated 30/06/2022;
  • Decree 69/2018/ND-CP dated 15/05/2018;
  • Decree 128/2020/ND-CP dated 19/10/2020;

According to the above documents, forklifts are not on the list of goods banned from import. For used forklifts, they are on the list of conditional imports, subject to quality inspection as prescribed. When carrying out procedures for importing hand forklifts, it is necessary to pay attention to the following points:

  • Hand forklifts must be inspected for quality when imported;
  • Determine the correct HS code to determine the correct tax and avoid being fined;
  • Imported hand forklifts must have a label according to Decree No. 43/2017/ND-CP;

To determine the correct hs code of the hand forklift You need to understand the characteristics of the goods: Capacity, material, operating principle of the product.

2.1 Hand Forklift HS Code

HS (Harmonized System) code is a series of codes that are common to all goods around the world. Between different countries in the world, there is only a difference in the number of tails. Therefore, the first 6 digits of the worldwide hs code for an item are the same. Here, Just In Time would like to share with you the hs code board of hand lifts.

Describe

84271000

Autonomous vehicles powered by electric motors

Import duty is an obligation that the importer must fulfill when carrying out procedures for importing hand trucks. Tax obligations are mandatory and goods are only cleared when the tax obligation has been fulfilled.

There are two types of import taxes, namely VAT and import tax. Import duties depend on the hs code of the selected goods. The import tax calculation method of hand forklifts is as follows:

Import tax determined according to the import tax hs code is calculated according to the formula:
Import tax = CIF value x % tax rate

Import VAT is determined according to the formula:
Value Added Tax = (CIF Value + Import Tax) x % VAT rate.

According to the above formula, it can be seen that the import tax of hand forklifts belongs to the imposed tax rate. The tax rate depends on whether the order has a certificate of origin or not. If there is a certificate of origin (c/o), a special preferential tax rate may be applied.

Those are the basic label contents that need to be affixed to the goods. The information presented must be in English or other languages that must be translated. Or any place as long as it is convenient to check and easy to see. Labeling in the right place will help save time for inspection when carrying out smart watch import procedures.

For tray goods on the market, it is necessary to show more information. Such as manufacturer, quantity of goods, specifications, date of manufacture, safety warnings.

Labeling goods is caught in accordance with the law. If the goods are not labeled when imported or the content of the goods label is wrong. The importer faces the following risks:

  • Being fined according to regulations, the fine level is specified in Article 22 of Decree 128/2020/ND-CP;
  • Not entitled to special preferential import tax because the certificate of origin will be rejected;
  • Goods are easily lost or damaged due to the absence of warning labels for loading, unloading and transportation;
