Lithium Battery Import Procedures

Currently, businesses in Vietnam have an increasing demand for importing Lithium Batteries to serve production, trade, etc. However, regulations on Lithium battery import procedures face many challenges, especially when faced with safety and environmental requirements. JIT will provide information on Lithium battery import procedures based on our practical experience in Vietnam.

I. Regulations and Legal Requirements for Importing Lithium Batteries

Used or second-hand lithium batteries are prohibited from being imported into Vietnam under Decree 69/2018/NĐ-CP as they fall under the category of used information technology products. Therefore, any lithium batteries imported into Vietnam must be 100% brand new.

Before importing, businesses must adhere to the following regulations to ensure compliance and avoid delays or penalties during customs clearance:

  1. For lithium batteries in handheld devices (e.g., mobile phones, laptops, tablets):
    Compliance must be declared per Appendix II, Circular No. 04/2023/TT-BTTTT.
  2. For lithium batteries in electric vehicles:
    Compliance must follow Appendix II, Circular No. 12/2022/TT-BGTVT.
  3. Labeling requirements:
    Shippers must label goods according to Circular No. 43/2017/NĐ-CP before shipping to avoid penalties.

II. HS Code and Import Tax Rates for Lithium Batteries

The HS code for lithium batteries varies based on their use. Below are the latest HS codes according to the 2024 tax schedule:

  • HS Code 85076031: For batteries used in laptops, including notebooks and subnotebooks.
  • HS Code 85076032: For batteries used in aircraft.
  • HS Code 85076039: Other types.

Tax Rates:

  • VAT: 8%
  • Normal Import Duty: 5%
  • Preferential Import Duty: 0%

Special preferential import duties of 0% apply to all countries and territories with which Vietnam has signed trade agreements (e.g., ACFTA, ATIGA, AJCEP, AKFTA, VN-EAEU) when accompanied by a certificate of origin (C/O).

III. Latest Procedures for Importing Lithium Batteries

1. Preparing the Declaration of Compliance

The compliance declaration dossier includes:

  • Business registration certificate.
  • Technical documents for the lithium battery provided by the exporter, including:

- Design drawings.

- Technical description.

- Quality test report.

- Test results conducted by an authorized laboratory.

After the system has responded that the enterprise's profile meets the standards, submit a hard copy, the Department of Standards and Measurement will sign and stamp. Of which, 1 copy is submitted to customs and 1 copy is kept by the enterprise.

2. Import Procedures

Step 1: Register the Compliance Declaration

Register with the Telecommunication Authority. Required documents include:

  • Compliance registration form.
  • Sales contract.
  • Commercial invoice.
  • Packing list.
  • Bill of Lading (B/L).
  • Certificate of Origin (C/O).

Submit the completed hard copy of the approved documents to the relevant certification agency for stamping and signatures.

Step 2: Customs Declaration

Submit the electronic customs declaration and prepare the set of documents including the quality inspection registration.

  • Quality inspection registration: Submit the original
  • Commercial invoice
  • Packing list
  • Bill of Lading
  • Certificate of Origin (C/O)

We will submit the above documents to Customs, carry out customs clearance procedures and bring the goods to the warehouse.

Step 3: Testing and Issuing the Compliance Declaration

The process of declaring conformity of Lithium batteries includes the following steps:

  • Enterprises prepare conformity declaration dossiers according to regulations (as mentioned above)
  • Enterprises submit conformity declaration dossiers to the Department of Telecommunications (or units authorized by the Department of Telecommunications to receive dossiers).
  • The Department of Telecommunications receives and appraises dossiers.
  • The Department of Telecommunications issues a Notice of receipt of conformity declaration dossiers.
  • Enterprises are allowed to manufacture, import and circulate Lithium batteries in the Vietnamese market.

* Note: Within 15 days from the date of customs clearance of the shipment, enterprises must complete the dossier to return the results of the quality inspection of the equipment to the place where the quality inspection was registered.

Step 4: Submit the Finalized Compliance Declaration to Customs

After receiving the declaration of conformity, the enterprise submits 1 copy with product images (printed in color, with hanging marks), stamps, and labels to the Customs authority. At this point, the import of Lithium batteries is completed and the product is allowed to circulate on the market.
